Building Board of Appeals

Purpose: The Board of Building Appeals is established to carry out the purposes and duties as provided in state and local law, and to act and decide on applications for building appeals. An application for building appeal shall be based on (1) a claim that the true intent of the applicable code, or the rules legally adopted pursuant thereto, have been incorrectly interpreted; (2) the provisions of the code do not apply; or (3) an equally good or better form of construction is proposed. The Board shall have no authority to waive requirements of the code. Decisions or recommendations of the Board of Building Appeals are binding on both the applicant for appeal and the governmental authority and are, therefore, final decisions of an administrative agency. 

 

 

Process

Step 1.Process

An Appeal shall be filed with the Laramie County Planning and Development Office within twenty (20) days from the decision or action. 

Step 2.Submit Application by meeting all the requirements

  • Application form must be filled out by the party submitting the appeal. A document from the "Agent" or "Other" describing the relationship or authorization to act on behalf of the owner.
  • After receiving the appeal, the Senior Permit Technician will forward correspondence to the Building Board of Appeals. 

Step 3.The Building Board of Appeals (BBOA) will meet within ten (10) days after the appeal is received.

Step 4.Decision by Board

At the conclusion of the hearing, the Board shall close the evidence, and either issue a decision at the time of or take the matter under advisement. All decisions shall be made through motion, second and a majority vote of the quorum of the Board.  If the matter is taken under advisement, a written decision shall be issued no later than thirty (30) days from the date of the hearing. A copy of the decision shall be provided to each party by mail or personal delivery. 

 

NOTE:

Any person aggrieved by the decision of the Board may appeal that decision to district court pursuant to Wyo. Statute W.S. 16-3-114.
