Posting a Bond

The Clerk of District Court will not accept a personal check when posting a bond. The bond must be paid with cash, certified check or money order.

When posting a cash bond of over $10,000.00 you will be required to complete the IRS Form 8300. (Report of Cash Payments Over $10,000 Received in a Trade or Business) Proof of identity is required for the completion of this form along with a taxpayer identification number or a social security number.

When posting a surety bond you must use a bondsman that is licensed in the State of Wyoming and has been approved by our court.

Our court does not accept any type of real property or personal property as surety when posting a bond.

Since posting a bond takes approximately an hour, you will need to be at our office by 4:00 p.m. to complete this transaction. The person posting the bond will be responsible for hand delivering the paperwork to the Laramie County Detention Facility.

Below is a section from the Appearance Bond form. Please read over this carefully, as the person posting the bond (Surety), and the Principal/Defendant, will need to agree with all of these conditions.

Wyoming Statutes, 1977, as the same may have from time to time been amended: and the said defendant has appeared in Court and been admitted to bail in the sum of ($_______________);

WITNESSETH: That said defendant, as principal, and all endorsers, jointly and severally, as sureties, bind themselves, their heirs executors and assigns unto the State of Wyoming in the above penal sum.

THE CONDITION of this bond is that the defendant is to appear in the District Court of the First Judicial District, in the City of Cheyenne, County of Laramie, State of Wyoming, in accordance with all orders and directions of the court relating to the appearance of the defendant before the Court in the above entitled case; and if the defendant appears as ordered, then this bond to be void, but if the defendant fails to perform this condition or appear as ordered, payment of the amount of the bond shall be due forthwith. If the bond is forfeited and the forfeiture is not set aside or remitted, judgment may be entered upon motion in the said District Court against each debtor jointly and severally for the amount above stated together with interest and costs, and execution may be issued or payment secured as provided by the Wyoming Rules of Criminal Procedure and by other laws of the State of Wyoming.

AND FURTHER to abide all orders and conditions of the Court which may be endorsed upon the original Appearance Bond.

AND FURTHER to appear for arraignment before the above Court as the same may be ordered by the Court, and thereafter present himself on the first day of the next Term of Court or from time to time before said Court, or any Court to which the Information may be assigned, the place, date and time of each appearance as ordered by the Court.

THIS AMOUNT OF THIS OBliGATION IS ENFORCEABLE AGAINST:

  1. The defendant upon his own recognizance.
  2. The forfeiture of the money posted in the amount of $__________, and thereafter against the defendant and his sureties, jointly and severally on the deficit, if any.
  3. The assets or securities of the corporate surety appearing hereon the same to be by action in a Court of proper jurisdiction.

IF THE above bond is a percentage bond, should the defendant fail to appear or comply with the conditions of this bond, the below signed acknowledges that they will not only forfeit the bond that has been posted, but will also be responsible for the remainder of the bond. (Picture I.D. will be required when posting a percentage bond.)

IT IS FURTHER UNDERSTOOD THAT THE BOND POSTED IS TO BE CONSIDERED THE PROPERTY OF THE COURT AND MAY ALSO BE USED TO PAY FINES, COSTS, RESTITUTION, AND OTHER CHARGES DEemED APPROPRIATE BY THE COURT.

I, THE ABOVE NAMED DEFENDANT, AGREE TO ALL CONDITIONS SET IN COURT PERTAINING TO THIS BOND INCLUDING THE FolLOWING:

  • THE DEFENDANT shall have no probable cause or warrant arrests for driving under the influence of intoxicants or any other criminal offense other than minor traffic violation.
  • THE DEFENDANT shall not leave Laramie County, Wyoming without prior approval of this Court and shall maintain contact with his attorney.
  • THE DEFENDANT shall not have any contact with any victim of this case except through his attorney or the attorney's investigator.
  • OTHER CONDITIONS set in Court.

When a bond is posted, it is held by the Clerk of the District Court until the defendant is sentenced or a disposition has been made in the case. The bond posted is considered the property of the court and may be used to pay fines, costs, restitution, and other charges deemed appropriate by the court.

The bond will be released, only after the defendant has been sentenced and the court order has been filed in our office. Bond refund checks are only generated once a day, so it may be the next day before you can receive your bond check.

Only the person, who posted the bond, may pick up the bond check. We require a picture I.D. when picking up your bond check.

You will need to keep the Clerk of the District Court advised of your current address and phone number at all times. This will help us get your bond refunded back to you in a timely manner.
